Terms and Conditions – Pitch Prep

These Terms and Conditions ("Terms") govern your access to and use of the Pitch Prep web and mobile applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

The Service

Pitch Prep provides tools to help users practice and improve pitch presentations, including recording, feedback, and subscription-based features. The Service may be updated or modified from time to time.

Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Keep your account credentials secure
• Notify us promptly of any unauthorized use of your account

You are responsible for all activity that occurs under your account.

Free Trials

Pitch Prep may offer a free trial period. Unless otherwise stated:

• Free trials provide temporary access to paid features
• At the end of the trial, access may expire unless you start a paid subscription
• Trial eligibility is determined by Pitch Prep and may be limited to one trial per user or account

We reserve the right to modify or terminate free trials at any time.

Subscriptions and Payments

Subscriptions

Certain features of the Service require a paid subscription. Subscription plans, pricing, and billing intervals are displayed at the time of purchase.

Billing

• Payments are processed by third-party payment providers (Stripe)
• Subscriptions automatically renew unless canceled before the end of the current billing period
• You authorize us and our payment providers to charge applicable fees and taxes

Cancellations

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for unused portions of a billing period, except where required by law

Changes to Plans and Pricing

We may change subscription plans, features, or pricing from time to time. Changes will not apply retroactively and will take effect at the start of your next billing period, unless otherwise required by law.

User Content

You retain ownership of content you submit to the Service. By submitting content, you grant Pitch Prep a limited, non-exclusive license to host, store, and process the content solely to operate and improve the Service.

You are responsible for ensuring that your content does not violate any laws or third-party rights.

Acceptable Use

You agree not to:

• Use the Service for unlawful or abusive purposes
• Attempt to gain unauthorized access to the Service or systems
• Interfere with or disrupt the operation of the Service
• Upload content that is harmful, offensive, or infringes on intellectual property rights

We reserve the right to suspend or terminate accounts that violate these Terms.

Intellectual Property

The Service, including all software, design, text, and logos, is owned by or licensed to Pitch Prep and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if required for legal or security reasons. Upon termination, your right to use the Service will cease.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Pitch Prep shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the Service.

Governing Law

These Terms are governed by the laws of Canada, without regard to conflict of laws principles.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
